U.S. Export Controls

Background

U.S. export controls aim at protecting the national security, economic interests and foreign policy of the United States.  Export laws regulate the shipment, transfer or disclosure of controlled items, technology and software to foreign countries or to foreign persons and entities within the U.S. 

Activities subject to Export Controls

You may be required to comply with the U.S. export controls laws and regulations in any of the following cases:

  • Your contract (prime or sub-contract) states that the project is subject to the EAR or the ITAR, and the Fundamental Research exemption cannot be used;
  • You intend to accept restrictions on publication or foreign participation;
  • You plan to work with individual(s) from embargoed countries or sanctioned/restricted countries;
  • You plan to work with an external consulting company;
  • You plan to release to a foreign national export-controlled items or "use" technology*;
  • Your project involves military, intelligence, space, nuclear, encryption articles, services, technical data or software;
  • You plan to import or export a defense item (USML item);
  • You plan to disclose export-controlled items or information during courses, conferences, public meeting, trade show etc.;
  • You plan to travel outside of the United States;
  • You plan to ship or disclose items or information either to a foreign person within the United States or to a foreign country.;

Role of the Export Controls team at the Office of Research

The Export Controls team can help the Pitt Community with the following:

  • Determining whether the import or the export (including "deemed-export") requires a license under the U.S. regulations;
  • Evaluating whether a license exception can be used;
  • Providing Restricted Parties screenings;
  • Applying for a license with the relevant US Governmental agency;
  • Keeping appropriate records for audit purposes;
  • Filing the additional documentations related to the import or export.
